Dispute Resolution & Arbitration

Commercial and civil litigation, domestic and international arbitration, mediation, debt recovery and consumer claims, taken from filing through to enforcement.

Overview

The firm represents and advises clients across the full spectrum of contentious work, from first filing to final execution. This includes commercial and general civil litigation, declaratory suits, domestic and international arbitration, mediation and conciliation, debt recovery, consumer disputes and motor accident claims. The approach is the same in every forum: understand the commercial or personal stakes behind the dispute, and choose the fastest legally sound route to resolution rather than the longest one.

What this covers

01

Commercial & General Civil Litigation

Representation before civil and commercial courts in suits for recovery of money, specific performance, injunctions, partnership and property disputes, and breach of contract claims, from drafting the plaint or written statement through to trial and appeal.

For example: A supplier sues a distributor for unpaid dues under a supply agreement and seeks an injunction restraining sale of pledged stock.
02

Declaratory Suits & Declaration Certificates

Suits seeking a court’s formal declaration of a legal right, title or status — such as title to property, legitimacy of a document, or validity of a transaction — where the relief sought is clarity rather than damages or possession.

For example: A family member seeks a declaration that a disputed sale deed executed by a since-deceased relative is void for lack of free consent.
03

Domestic Commercial Arbitration (Sections 9, 11 & 34)

Advising on and appearing in arbitration proceedings under the Arbitration and Conciliation Act, 1996 — interim relief under Section 9, appointment of arbitrators under Section 11, and challenges to awards under Section 34, alongside representation in the arbitration itself.

For example: A construction company applies under Section 9 for an interim order freezing a counterparty’s bank guarantee pending the outcome of arbitration over a delayed project.
04

Mediation & Conciliation

Structured, without-prejudice negotiation before a neutral mediator or conciliator, used to settle commercial, family and civil disputes without the cost and delay of trial, including court-annexed mediation referred under the Code of Civil Procedure.

For example: Two business partners winding up a joint venture use mediation to agree a division of assets rather than litigate the dissolution for years.
05

Debt Recovery & SARFAESI (DRT / DRAT)

Recovery of dues on behalf of lenders and borrowers before the Debt Recovery Tribunal and Debt Recovery Appellate Tribunal, and advisory and litigation support under the SARFAESI Act on enforcement of security interests, including symbolic and physical possession.

For example: A bank initiates SARFAESI proceedings to take possession of mortgaged property after a borrower defaults on a secured loan.
06

Consumer Protection Litigation (NCDRC)

Complaints and appeals concerning deficiency in service or defective goods before the District, State and National Consumer Disputes Redressal Commissions, including matters relating to real estate delay, insurance repudiation and e-commerce disputes.

For example: A homebuyer files a complaint before the State Commission against a builder for possession delayed well beyond the promised date.
07

Motor Accident Claims (MACT)

Claims for compensation arising from road accidents, filed on behalf of victims or their families before the Motor Accident Claims Tribunal, and defence of such claims on behalf of owners and insurers.

For example: The family of an accident victim files a compensation claim before the MACT against the driver, owner and insurer of the offending vehicle.
08

International Commercial Arbitration

Advisory and representation in cross-border arbitration under institutional rules such as SIAC, LCIA and ICC, and assistance with recognition and enforcement of foreign arbitral awards in India under the New York Convention framework.

For example: An Indian company enforces a Singapore-seated SIAC award against a domestic counterparty’s assets before the Indian courts.
